1. Scope of this Policy

This Privacy Policy describes how Formosi, Inc. (“Formosi,” “we,” “us” or “our”) collects, uses, discloses and protects personal information when you visit Formosi websites, contact us, book a meeting, become a client, use a Formosi service or interact with a website, form, application, portal, communication tool or other service that links to this Policy (collectively, the “Services”).

This Policy does not govern websites, platforms or services operated independently by third parties. Their privacy policies apply to their services.

2. Information we collect

The information we collect depends on how you interact with Formosi and which Services you use.

Sources of information

We collect information directly from you; automatically from browsers, devices and cookies; from Formosi clients when we provide services on their behalf; from service providers and advertising partners; and from publicly available sources such as business websites, public profiles and business directories.

Payment information

Payment information may be collected directly by a third-party payment processor. Formosi generally does not receive or store your complete payment card number.

Please do not send highly sensitive information unless we specifically request it through an appropriate secure method. This includes Social Security numbers, government identification numbers, medical information and full financial account credentials.

3. How we use information

We may use personal information to:

• Respond to questions, schedule meetings and provide proposals.
• Create, configure, operate and support websites, CRM tools, booking systems, communication tools, advertising services and other Services.
• Process payments, invoices, subscriptions and related business records.
• Send service communications, appointment reminders, account notices and support messages.
• Send marketing communications where permitted and honor opt-out requests.
• Measure site usage, campaign performance, calls, leads and other business outcomes.
• Personalize and improve our Services, content and customer experience.
• Detect fraud, prevent misuse, maintain security and troubleshoot technical issues.
• Comply with law, enforce agreements and protect Formosi, our clients and others.
• Carry out another purpose disclosed when information is collected or with your direction or consent.

4. How we disclose information

We do not sell personal information in exchange for money. We may disclose personal information to the following categories of recipients when reasonably necessary:

• Service providers and contractors that support hosting, CRM, scheduling, communications, payments, analytics, advertising, security, customer support and professional services.
• Formosi clients when you contact or transact with that client through a service Formosi operates on the client’s behalf.
• Advertising and analytics partners that help measure campaigns, understand site use and deliver or evaluate advertising.
• Professional advisers such as attorneys, accountants, auditors and insurers.
• Government authorities or other parties when required by law, legal process or a valid request, or when necessary to protect rights, safety and security.
• Parties to a business transaction involving a merger, financing, acquisition, reorganization, sale of assets or similar event.
• Other recipients at your direction or with your consent.

Some analytics and advertising activities may be treated as a “sale” or “sharing” under certain state privacy laws even when no money changes hands. Available opt-out choices are described below.

5. Information we process for clients

Formosi provides websites, forms, CRM, communications, automation, advertising and related services to businesses. In that role, we may process personal information on behalf of a Formosi client under that client’s instructions.

If you submitted information to one of our clients, booked with that client or received a communication from that client, the client is generally responsible for its own privacy practices. Requests concerning that information should first be directed to the business with which you interacted. We will support our client as required by contract and applicable law.

6. Text messages, calls and email

If you provide your telephone number and opt in, Formosi may send service-related or marketing text messages as described at the point of collection. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of text messages and HELP for assistance. Consent to marketing text messages is not a condition of purchase.

Mobile information will not be shared with third parties or affiliates for their own marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with third parties, except with providers that help deliver messaging services or as required by law.

You may unsubscribe from marketing emails using the unsubscribe link in the message. We may still send non-promotional communications about an account, transaction, appointment or service relationship.

Calls may be monitored or recorded for quality, training, security or recordkeeping where permitted by law and with any notice or consent required.

7. Cookies, analytics and advertising

Formosi and our providers may use cookies, pixels, tags, local storage and similar technologies to keep Services working, remember preferences, understand site activity, secure our Services, measure campaigns and support advertising.

You can manage cookies through your browser or device settings. Blocking some cookies may affect site functionality. Some browsers also offer a Do Not Track setting. Because there is no uniform standard for Do Not Track signals, our Services do not currently respond to them.

Where required by applicable law, we recognize supported opt-out preference signals, such as Global Privacy Control, as a request to opt out of the sale or sharing of personal information for the browser and device sending the signal.

8. Retention, security and transfers

How long we keep information

We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to provide Services, maintain business and transaction records, meet legal and contractual obligations, resolve disputes, prevent fraud and enforce agreements. Retention periods vary based on the type of information, the nature of the relationship and applicable requirements.

Security

We use reasonable administrative, technical and physical safeguards designed to protect personal information. No website, network, transmission or storage system is completely secure, so we cannot guarantee absolute security.

United States processing

Formosi is based in the United States. Information may be processed and stored in the United States and other locations where Formosi or our providers operate. Those locations may have different privacy laws than your place of residence.

9. Your privacy rights

Depending on where you live and subject to applicable exceptions, you may have the right to request that we:

• Confirm whether we process your personal information and provide access to it.
• Correct inaccurate personal information.
• Delete personal information.
• Provide a portable copy of certain information.
• Opt you out of certain targeted advertising, sale or sharing activities.
• Limit certain uses of sensitive personal information, where applicable.
• Review or appeal a decision concerning a privacy request, where applicable.

We will not discriminate against you for exercising a privacy right. We may need to verify your identity before completing a request. An authorized agent may submit a request where permitted, but we may require proof of authorization and identity verification.

10. Children’s privacy

The Services are intended for businesses and adults and are not directed to children under 13. We do not knowingly collect personal information directly from children under 13. If you believe a child has provided personal information to us, please contact us so we can review and address the request.

11. Changes to this Policy

We may update this Policy to reflect changes in our Services, technology, business practices or legal obligations. The updated version will be posted on this page with a revised “Last updated” date. If a change is material, we may provide additional notice where appropriate.
